The Investigation and Commencement of Repair (Scotland) Regulations 2026 – Awaab’s Law – Landlord Guidance

As you may be aware, the Investigation and Commencement of Repair (Scotland) Regulations 2026 will come into force on 6 October 2026, introducing new statutory duties on landlords to promptly address damp and mould. This is also known as ‘Awaab’s Law’.

Guidance for landlords was developed by using feedback from stakeholder organisations across the sector, and is now live: www.gov.scot/isbn/9781807754594-

From this date, if you are a social or private landlord in Scotland, you will be required to:

• Ensure reports of damp or mould are investigated within 10 working days.
• Produce a written summary of the investigation findings within 3 working days of the investigation’s conclusion.
• Ensure any necessary repair work is commenced within 5 working days of the conclusion of the investigation.
• Once repair work commences, ensure the repair is completed:
  • Within a maximum of 20 working days for social landlords.
  • As soon as reasonably practicable for private landlords.

The Guidance provides examples of where exceptional circumstances may apply, such as delays beyond a landlords’ control.
